# TOS

By accessing or using the Bot, you agree to comply with the terms and conditions of this Agreement. If you do not agree to these terms and conditions, please refrain from using the Bot.

1. Description of the Bot

   The Bot is a software program that operates on the Discord platform, providing users with token-gating functionality and role management.
2. Use of the Bot

   You may use the Bot for personal or non-commercial purposes only. It is strictly prohibited to use the Bot for any illegal or unauthorized activities.
3. Limitations on Use
   * You are not permitted to copy, modify, distribute, sell, or lease any part of the Bot or its underlying software without our express written authorization.
   * Reverse engineering, decompiling, or disassembling the Bot or any of its components is strictly prohibited.
   * You must not utilize the Bot in any way that could cause damage, overload, or impair our servers or networks.
4. Intellectual Property
   * The Bot, including its software, graphics, images, and other materials, is the exclusive property of Apello and is protected by intellectual property laws.
   * Unauthorized usage of our trademarks, logos, or other proprietary information is strictly prohibited without our prior written consent.
5. Disclaimer of Warranties
   * THE BOT IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF INFORMATION ACCURACY, SERVICES, UNINTERRUPTED ACCESS, OR PRODUCTS PROVIDED THROUGH OR IN CONNECTION WITH THE BOT. APPELLO DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO: 1) THE AVAILABILITY, ACCURACY, USEFULNESS, OR CONTENT OF INFORMATION, PRODUCTS, OR SERVICES; AND 2) WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE.
   * THIS DISCLAIMER OF LIABILITY APPLIES TO ANY DAMAGES OR INJURIES CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT, DESTRUCTION, OR UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF RECORDS, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, OR ANY OTHER LEGAL THEORY.
6. Limitation of Liability

   APPELLO, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, AND DIRECTORS SHALL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND, WHETHER DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE BOT. THIS INCLUDES PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, PROFITS, BUSINESS, OR ANTICIPATED SAVINGS, LOSS OF USE, GOODWILL, OR DATA, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE AND WHETHER ARISING FROM CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.
7. Indemnification

   You agree to defend, indemnify, and hold Apello and its affiliates, licensors, service providers, employees, agents, officers, and directors harmless from any claims, damages, obligations, losses, liabilities, costs, or debts, including attorney's fees, arising from: (i) your use of the Bot; (ii) your violation of any provision of this Agreement
